Terms and Conditions for Tier1 Luxury Rentals

1. Definitions

Tier1 Luxury Rentals offers an extensive selection of premium luxury and exotic vehicles from renowned manufacturers worldwide, including but not limited to Lamborghini,  Aston Martin, Jaguar, BMW, Mercedes-Benz, Audi, Ferrari, Porsche, Bentley, Range Rover, Rolls-Royce, Land Rover, Cadillac, McLaren, and more.

2. Rental, Indemnity, and Warranties

This agreement constitutes a contract for the rental of the vehicle. Tier1 Luxury Rentals reserves the right to repossess the vehicle at the renter's expense without prior notice if the vehicle is abandoned or used in violation of the law or this Agreement. Renters agree to indemnify, defend, and hold Tier1 Luxury Rentals harmless from all claims, liabilities, costs, and attorney fees resulting from or arising out of the rental and the renter's use of the vehicle. Tier1 Luxury Rentals makes no express, implied, or apparent warranties regarding the vehicle, including but not limited to merchantability or fitness for a particular purpose.

3. Condition and Return of Vehicle

Renters must return the vehicle to the agreed upon location at the specified date and time and in the same condition as received. If the vehicle is returned after business hours, the renter remains responsible for its safety and any damage or loss until inspected upon the next business opening. Any service to the vehicle or replacement of parts or accessories during the rental period must receive prior approval from Tier1 Luxury Rentals. Renters are responsible for checking and maintaining all fluid levels.

4. Responsibility for Damage or Loss; Reporting to Police

Renters are liable for all loss, theft, or damage to the vehicle, including repair costs or the actual cash retail value of the vehicle if not repairable, plus loss of use, diminished value, and administrative expenses incurred processing the claim. Renters must promptly report all accidents, thefts, or incidents of vandalism to Tier1 Luxury Rentals and the police.

5. Breach of Agreement

The following acts constitute prohibited uses of the rental vehicle and breach this agreement:

• Operating the vehicle under the influence of drugs or alcohol.
• Providing false or misleading information to obtain or extend the rental.
• Using the vehicle for illegal purposes or in violation of traffic laws.
• Participating in races, speed tests, or contests.
• Teaching anyone to drive.
• Transporting hazardous materials or illegal substances.
• Driving beyond geographic limitations indicated.
• Overloading the vehicle or towing beyond capacity.
• Driving on unpaved roads or in off-limits areas.
• Failing to secure cargo properly.
• Operating a manual transmission without experience.
• Engaging in willful, wanton, or reckless conduct.
• Failing to report accidents involving personal injury or property damage.
• Transporting animals in the vehicle.
• Removing vehicle tracking devices.

Renters waive all recourse against Tier1 Luxury Rentals for any criminal reports or prosecutions resulting from a breach of this agreement.

6. Insurance

Renters are responsible for all damage or loss they cause to others. Renters agree to provide auto liability, collision, and comprehensive insurance covering themselves, Tier1 Luxury Rentals, and the vehicle. Tier1 Luxury Rentals may provide auto liability insurance as required by state law or where renters have no auto liability insurance. The provided insurance is secondary to any other valid and collectible insurance. Renters and Tier1 Luxury Rentals reject certain insurance coverage as permitted by law.

7. Charges

Renters are liable for all charges due under this Agreement, including but not limited to time and mileage, additional drivers, optional products and services, fuel, taxes, traffic violations, towing fees, and cleaning costs if the vehicle is returned substantially less clean than rented.

8. Deposit

Tier1 Luxury Rentals may use the renter's deposit to cover any amounts owed under this Agreement.

9. Your Property

Renters release Tier1 Luxury Rentals, its agents, and employees from all claims for loss of or damage to personal property left in or carried by the vehicle or stored in our offices, regardless of negligence or responsibility.

10. Modifications

No term of this Agreement may be waived or modified except by a written agreement signed by Tier1 Luxury Rentals. Renters must return the vehicle for inspection and written amendment by Tier1 Luxury Rentals if they wish to extend the rental period. This Agreement constitutes the entire agreement between renters and Tier1 Luxury Rentals.

11. Miscellaneous

Waiver by Tier1 Luxury Rentals of any breach of this Agreement does not constitute a waiver of any additional breach or waiver of the renter's obligations. Renters release Tier1 Luxury Rentals from liability for consequential, special, or punitive damages. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions remain valid and enforceable.
